1.- IDENTIFICATION OF THE PARTIES.
On one hand, BIJOM JUANITO, S.L., hereafter HOSTAL JUANITA, located at Calle de la Paz, 44-door 5, 46006 Valencia (Valencia) with TAX ID B-98718463 and email: reservas@juanitahostal.com and phone number +34971314828, and owner of the domain WWW.JUANITAHOSTAL.COM, hereinafter Website, with the hostel located at Carrer Joan d’Austria, 17 in Ibiza (Illes Balears), with registration number HPM1361.
And on the other hand, the User, who hires the services offered through the Website and whose identifying details are those provided directly by them through the inclusion of their data in the various forms that HOSTAL JUANITA makes available to access any of the services offered through the Website.
2.- APPLICABLE LEGISLATION.
The present General Booking Conditions are subject to Spanish legislation, according to the provisions of Law 7/1998, of April 13, on General Booking Conditions; in the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws; in the Royal Decree 1906/1999, of December 17, which regulates Telephone or Electronic Booking with General Conditions; Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights; the Law 7/1996, of January 15, on the Regulation of Retail Trade; and in the Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce. 3.- SCOPE OF APPLICATION, ACCEPTANCE, AND MODIFICATION.
The present General Conditions of Reservation governing the provision of services, are intended to regulate the access and acquisition regime of the services provided by HOSTAL JUANITA to the User through the Website, constituting the legal framework that develops the contractual relationship.
The User will always have access, prior to the start of the Reservation process of the services, to the General Conditions of Reservation, which can be stored and/or reproduced on a durable medium.
HOSTAL JUANITA provides the User with an email address, reservas@juanitahostal.com, where they can contact through the contact form in order to address any doubts regarding these General Conditions of Reservation.
The User expressly accepts the full and unreserved adherence to these stipulations in the version published by HOSTAL JUANITA at the time the User accesses the Website and has been able to access these General Conditions of Reservation, or contracts the services they are interested in.
By accepting these General Conditions of Reservation the User declares:
- That they are a person capable of contracting.
- That they have read and accept these General Conditions of Reservation.
The User, who declares that they have sufficient legal capacity* to contract, will be bound to these GCR at the moment they make a reservation through any of the above-mentioned channels.
*LEGAL LIMITATIONS: It is understood that the User is not under 18 years old. Minors are technically restricted from registering on this Website and therefore may not make purchases or reservations, in compliance with legal regulations. Data sent by minors will not be processed, as the law prohibits it..
4.- MODIFICATION.
HOSTAL JUANITA may modify these General Booking Conditions, without affecting the services purchased by the User prior to the modification, provided there is sufficient cause or reason for it. It is considered that there is sufficient cause or reason for the modification, by way of illustration and not limitation, when its purpose is:
- To expand the range or number of services made available to the User or to improve existing ones.
- To adapt the services covered by this contract to the advances that may occur due to the development of new information technologies
- To modify, replace, or update the prices of the services offered through the Website.
5.- OBLIGATIONS OF THE PARTIES.
These General Booking Conditions apply to any Booking of services through the Website.
5.1.- Obligations of HOSTAL JUANITA:
HOSTAL JUANITA commits to fulfill the following contractual obligations arising from the commercial relationship with the User as a result of the Reservation of services by the same:
- To provide the User with the highest guarantees, the services requested by them in accordance with the provisions of these General Conditions of Reservation and without failing to adhere to contractual good faith.
- To expressly inform the user of the existence of these General Conditions of Reservation prior to the start of the Reservation procedure.
- To inform the user prior to the Reservation and in a specific, clear, precise, and unequivocal manner, about the specific characteristics of the services requested, such as their price and applicable taxes.
- To provide the User with a copy of the text of the General Conditions of Reservation. In addition, for those services that require it, the Specific Conditions that apply will be made available to the User prior to the Reservation.
- To comply with the regulations concerning the rights of consumers and users.
- To send the user proof or invoice of the contracted services once the stay is completed.
- To proceed with the registration of accommodations.
5.2.- Obligations of the User:
For their part, the User agrees to the following contractual obligations:
- To fully comply with what is established in the General Conditions of Reservation in the Reservation of the services offered by the Website.
- To complete the registration forms prior to the start of the booking procedure with truthful and current information to be able to access any of the services offered on the Website. Furthermore, the User guarantees and will be responsible for keeping them fully updated as long as their condition as a User on the Website lasts.

at the time of booking. -
Refrain from sending messages that somehow prevent or hinder the normal operation of the services offered by the
Website
. In any case, the User will be solely and entirely responsible for the content of the messages they write or send, as well as for the data they provide. - Maintain the confidentiality of the information provided and notify immediately the loss, misplacement, theft, robbery, unauthorized access, as well as its knowledge by third parties.
- Respect the rules of the establishment.
- Respect the number of occupants established in the reservation.
- Leave the room in the same condition of conservation and cleanliness as it was at the time of entry.
- Act diligently, conforming at all times to the standards of good use and contractual good faith throughout the contractual relationship.
6.- PAYMENT TERMS. PRE-CONTRACTUAL AND CONTRACTUAL COMPLETION.
Reservations can be made, as already indicated, through three channels: Website, email or phone call.
The advance payment to make the reservation consists of paying the price of the first night including VAT, however, and in case this percentage varies, the User will be previously informed through the Website or by email, depending on the chosen contracting channel. The rest of the price will be paid at the time of check-in.
When making an online reservation, the User will receive a confirmation email which will include confirmation that their purchase order is in the process of confirmation. Once the charge corresponding to their reservation has been made, the user will receive an email confirming it, which will serve as proof of their reservation.
The parties will be bound by this contract at the moment of the reservation payment.
7.- AVAILABILITY.
If HOSTAL JUANITA, despite acting with due foresight and diligence, is unable to provide the contracted rooms for reasons not attributable to them and if it is impossible to provide the services under the agreed conditions, HOSTAL JUANITA will offer the user the option to choose between a full refund of the payment or its replacement with another one of similar features in terms of category or quality. If the replacement service results in a lower category or quality, HOSTAL JUANITA will refund the difference.
8.- PRICES.
The prices listed on the website include the corresponding VAT, as well as additional taxes according to the applicable tax rate at the time of contracting. The User may know the amount of such costs at the time of contracting the service.
The prices for accommodations are indicated, depending on the case, per room and night. HOSTAL JUANITA is not responsible for possible errors in the prices published. In case of an error in the price of the services that the User has contracted, we will inform you as soon as possible and will give you the option to reconfirm your purchase at the correct price or cancel it. If we are unable to contact you, the Reservation will be considered canceled, and the amounts that had been paid will be fully refunded.
The price does not include the tourist tax established by the City Council, it will be the council with the deliberation of the Municipal Council, the one in charge of establishing the tourist tax, which will be paid per night and person.
HOSTAL JUANITA reserves the right to modify the list of prices published on the Website, whenever it deems appropriate. In any case, the foregoing shall not apply to those services contracted prior to the modification.
9.- PAYMENT METHODS
The User has the following payment methods available:
– Credit Card (MasterCard and Visa).
10.- ENTRY AND EXIT.
Regarding the check-in time, it will be from 14:00 hours until 6:00 hours of the following day.
As for the check-out time, the room must be vacated before 10:00 hours.
11. - CONDITIONS FOR CHILDREN AND EXTRA BEDS
Minors under 18 years of age must stay at the Hostel accompanied by their parents/guardians, or duly authorized adults. Hotel staff may require relevant documentation that identifies the responsible persons as authorized.
12.- PROCEDURE, CANCELLATION AND WITHDRAWAL RIGHTS, AND LEGAL WARRANTY.
12.1.- Procedure.
To exercise the rights of cancellation, withdrawal, and use of the warranty, the User must contact HOSTAL JUANITA through Tel. +34 971314828 or reservas@juanitahostal.com.
12.2.- Right to Cancellation.
In the event of cancellation, modification, or no-show, the following penalties will apply:
Reservations may be cancelled without penalty if done at least 7 days before the check-in date. If the cancellation occurs during the 7 days before the check-in date or if there is a no-show, no amounts will be refunded, and the amount will serve as a penalty to cover the incurred expenses.

12.3. Right of Withdrawal.
In accordance with article 103 letter L of the Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users, “The right of withdrawal shall not apply to contracts that refer to: The supply of accommodation services for purposes other than housing, transportation of goods, vehicle rental, food or services related to leisure activities, if the contracts specify a date or a specific period of performance”.
13. LIABILITY OF THE PARTIES.
13.1. Responsibility of HOSTAL JUANITA.
The content of this Website is presented solely for the purpose of promoting the services of HOSTAL JUANITA, without any other warranty of any kind.
The User is warned that the use of electronic systems entails certain risks. HOSTAL JUANITA will only be liable for damages that the User may suffer as a result of acquiring the services.
In particular, HOSTAL JUANITA disclaims any responsibility for possible damages:
- that may be caused by the lack of availability and/or continuity of the Website.
- that may be generated to the User in case it is impossible to provide the service object of these General Conditions of Reservation due to acts of force majeure, acts of God or other causes not attributable to HOSTAL JUANITA. For these purposes, the following are considered beyond their control by way of illustration and not limitation, (i) the modem, (ii) the User’s computer system, (iii) the browsing software, (iv) viruses, (v) the interconnection of telephone and electrical networks, (vi) ADSL, ISDN, and/or any other transportation or telecommunications infrastructure used by the User.
- due to the inadequate functioning of the Website if this is due to maintenance work, incidents, a malfunction of the User’s terminal or its insufficient capacity to support the necessary systems to use the service.
HOSTAL JUANITA does not guarantee the absence of viruses or other elements on the Website that may produce alterations in your computer system, nor the usefulness, accuracy, updating, or infallibility of the contents or services not controlled by them.
HOSTAL JUANITA will take appropriate measures to ensure a prompt response, but cannot be held responsible for delays due to telecommunications services, nor guarantee a specific timeframe for the provision of services.
13.2.- Responsibility of the User.
The User will be solely responsible for the consequences arising from the communication of data that is not true, as well as data belonging to persons other than the User themself User.
To adopt the necessary security measures, both personal and material, to maintain the confidentiality of their user name and password, as well; as to immediately notify HOSTAL JUANITA the loss, misplacement, theft, robbery or illegitimate access to their username, as well as its knowledge by third parties.
In the event of a breach by the User of their contractual obligations, HOSTAL JUANITA reserves the right to take appropriate legal actions, as well as the right to restrict access to the services offered on the Website.

14. BREAKDOWNS.
HOSTAL JUANITA will review the apartment prior to handing over the keys, ensuring that everything is in perfect condition and that the water, electricity, and other services that the room has to offer are functioning properly.
In the event that any of the facilities should fail to function or if any damage is observed in the water, electricity, or other services, the User must inform HOSTAL JUANITA so that they can then notify the appropriate authorized technical service to repair the fault as soon as possible.
In the event of an electrical outage or a local authority water supply cut-off, HOSTAL JUANITA will not be responsible for being unable to provide these supplies.
15. DESCRIPTIONS, PHOTOS AND EXPOSED EXTERNAL SERVICES.
We strive to provide you with quality information. The photos and descriptions entered are reviewed periodically. However, there may be differences in the furniture or interiors shown. Likewise, certain services and facilities, as well as the information about external services detailed on the website, may be temporarily out of service due to the season or being under repair. These changes will not entitle you to compensation or claims.
16. CONTRACT BREACH.
Both contracting parties shall proceed to comply with the obligations assumed in this contract in the terms established throughout it. In the event that either party fails to fulfill any of the essential obligations of this contract, or fulfills them defectively, the party that has complied with its obligations may consider that there has been a breach of the contract in the terms set out by Article 1.124 of the Civil Code, being empowered to choose between terminating the contract or demanding compliance, claiming, in both cases, the corresponding compensation for damages.
17. NOTIFICATIONS.
For the purposes of carrying out the appropriate notifications, HOSTAL JUANITA designates as contact address the one specified in the legal notice, as well as the email reservas@juanitahostal.com.
The email address provided by the User during the registration process on the Website, will be used by HOSTAL JUANITA for the purposes of making notifications to the User.
The User is required to keep the data used for notifications duly updated as referenced in this clause.
All notifications made by HOSTAL JUANITA to the User User will be considered validly made if they have been carried out using the previously indicated data and through the aforementioned means. HOSTAL JUANITA is not responsible for any damage that may occur due to the User’s breach of their obligation to keep their contact details up to date.
18. NULLITY AND INEFFECTIVENESS OF THE CLAUSES.
If any clause included in these General Reservation Conditions is declared wholly or partially void or ineffective, such nullity will affect only that provision or the part of it that is void or ineffective, with the rest of the General Reservation Conditions remaining in effect.
19. DURATION OF THE GENERAL BOOKING CONDITIONS.
The validity period of these General Booking Conditions will be the time they remain published on the Website and will apply from the moment the User proceeds to book any of the services.
20. ONLINE DISPUTE RESOLUTION.

21. LANGUAGE.
The language in which the contract is formalized is Spanish.
22. COMPETENT JURISDICTION.
In the event of a dispute between the parties, territorial jurisdiction shall, mandatorily, for the resolution of conflicts, be the Courts of Ibiza.
